US fines 5 intermediaries US$520,000 for violations of Shipping Act rules
THE US Federal Maritime Commission has imposed US$520,000 in fines on five transport intermediaries accused of breaking arcane rules of the Shipping Act.
The FMC said Volkswagen Konzernlogistiks ?a logistics subsidiary of automotive manufacturer Volkswagen Group had agreed to pay $170,000 after admitting it had "operated pursuant to unfiled space charters with other operators of ro-ro vessels, or pursuant to agreement amendments which were filed with the Commission but not yet effective under section 6 of the Shipping Act".
NVOCCs Orient Star Transport International, a Taiwanese firm, was fined $135,000 and California-based Ba-Shi Yuexin Logistics Development, was fined $100,000 for billing customers at rates "not in accordance" with their own tariffs.
Although accepting the fines the five firms all said their payments were not an admission to the alleged violations of the US Shipping Act or FMC regulations.
California-based NVOCC Thornley & Pitt was fined $65,000 and Jamaican NVOCC Razor Enterprise was fine $50,000 for "knowingly and wilfully obtaining transport at less than applicable rates".
FMC chairman Mario Cordero said the fines demonstrated the vigilance of the commission's area representatives and FMC Bureau of Enforcement.
